THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

10.2 Limitation of Liability

IN NO EVENT SHALL I PUTU ARKA SURYAWAN TECHNOLOGY SERVICES, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.

10.3 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless I Putu Arka Suryawan Technology Services and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

12. TERMINATION

12.1 Termination by You

You may terminate your use of our Services at any time by discontinuing use and, if applicable, deleting your account.

12.2 Termination by Us

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

12.3 Effect of Termination

Upon termination, your right to use the Services will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.

13. FORCE MAJEURE

We shall not be liable for any failure or delay in performance under this Agreement which is due to an earthquake, flood, fire, storm, natural disaster, act of God, war, terrorism, armed conflict, labor strike, lockout, or boycott.

14. GOVERNING LAW

These Terms shall be interpreted and governed by the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. DISPUTE RESOLUTION

15.1 Negotiation

Any disputes arising out of or relating to these Terms or the Services shall first be resolved through good faith negotiation between the parties.

15.2 Mediation

If negotiation fails, disputes shall be resolved through mediation conducted by a mutually agreed-upon mediator.

15.3 Arbitration

If mediation fails, any remaining disputes shall be resolved through binding arbitration in accordance with the rules of the Indonesian Arbitration Board (BANI).

16. SEVERABILITY

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

17. WAIVER

No waiver by the Company of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

18. ENTIRE AGREEMENT

These Terms and our Privacy Policy constitute the sole and entire agreement between you and I Putu Arka Suryawan Technology Services with respect to the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

19. AMENDMENTS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
